How long do I have to file a personal-injury claim in Florida?

As of 2023, Florida reduced the general negligence statute of limitations from four years to two years (HB 837). Wrongful-death claims remain two years. Maritime and federal claims have their own deadlines.

What if I was partially at fault?

Florida now follows modified comparative negligence. If you are more than 50% at fault, you recover nothing; at 50% or below, your recovery is reduced by your percentage of fault.

Do I still have a case if I don't have health insurance?
